Terms of Service

1. Introduction and Acceptance of Terms

These Terms of Service (“Terms”) govern access to and use of the educational services, programs, communications, assessments, and related offerings provided by Maple Ridge Learning Academy (“Maple Ridge Learning Academy,” “we,” “us,” or “our”).

By enrolling a student, using our services, accessing our facilities, communicating with us, or otherwise participating in any program or service offered by Maple Ridge Learning Academy, the student, parent, guardian, or other authorized representative (“you” or “your”) agrees to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

These Terms apply to all services offered by Maple Ridge Learning Academy, including elementary and middle school education, after-school tutoring support, homework help and study skills coaching, enrichment programs in arts, science, and technology, and student assessment and progress reporting.

2. Scope of Services

Maple Ridge Learning Academy provides educational and student support services, which may include, without limitation:

We may modify, suspend, or discontinue any service, program, schedule, curriculum component, or activity at any time, subject to applicable law and any specific written agreement with you.

Unless expressly stated otherwise in writing, our services are educational in nature and do not constitute medical, psychological, therapeutic, legal, or financial advice.

3. User Obligations and Responsibilities

You agree to provide accurate, current, and complete information when registering a student or otherwise interacting with Maple Ridge Learning Academy, and to promptly update any information that changes.

As a condition of participation, you agree that:

Maple Ridge Learning Academy may suspend or terminate participation if a student or user fails to comply with these Terms, school policies, or applicable law, or if continued participation is reasonably determined to be unsafe or disruptive.

4. Payment Terms and Conditions

Fees for tuition, tutoring, enrichment programs, assessments, materials, and any other services will be communicated to you in advance through a fee schedule, invoice, registration form, written agreement, or other notice from Maple Ridge Learning Academy.

Unless otherwise stated in writing:

Maple Ridge Learning Academy reserves the right to revise fees for future terms, programs, or services upon reasonable notice. Any fee changes will not apply retroactively unless expressly agreed in writing or required by law.

5. Cancellation and Refund Policy

Cancellation and refund rights, if any, are subject to the specific program, registration terms, and applicable consumer protection laws in Quebec and Canada.

Nothing in these Terms limits any mandatory rights you may have under applicable consumer protection legislation.

6. Liability Limitations

To the fullest extent permitted by applicable law, Maple Ridge Learning Academy, its directors, officers, employees, contractors, volunteers, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, or loss of opportunity, arising out of or related to the use of our services.

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the services shall not exceed the amount actually paid by you to Maple Ridge Learning Academy for the specific service giving rise to the claim during the three (3) months preceding the event giving rise to liability, or such lesser amount as may be required by law.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for gross negligence, wilful misconduct, fraud, or any other liability that cannot lawfully be limited under applicable law.

Parents and guardians acknowledge that participation in educational and enrichment activities may involve ordinary risks, including minor injuries or property loss, and agree to supervise and disclose relevant information as reasonably necessary to support student safety.

7. Intellectual Property Rights

All materials provided by Maple Ridge Learning Academy, including lesson plans, worksheets, assessments, reports, curricula, handouts, digital content, logos, designs, text, graphics, and other educational materials, are owned by or licensed to Maple Ridge Learning Academy and are protected by applicable intellectual property laws.

Except as expressly authorized in writing, you may not copy, reproduce, distribute, modify, publish, sell, sublicense, or create derivative works from our materials.

You are granted a limited, non-exclusive, non-transferable, revocable license to use materials provided to you solely for personal, non-commercial educational purposes in connection with participation in Maple Ridge Learning Academy services.

Any feedback, suggestions, or ideas you provide to Maple Ridge Learning Academy may be used by us without restriction or compensation, to the extent permitted by law.

8. Data Protection and Privacy

Maple Ridge Learning Academy collects, uses, discloses, and retains personal information in accordance with applicable privacy laws in Canada and Quebec, including the Act respecting the protection of personal information in the private sector, as amended, and other applicable legislation.

We may collect personal information such as student and parent/guardian names, contact details, emergency contacts, academic information, attendance records, assessment results, billing information, and any other information reasonably necessary to provide our services, maintain safety, communicate with you, and comply with legal obligations.

9. Force Majeure

Maple Ridge Learning Academy shall not be liable for any delay, interruption, suspension, or failure to perform its obligations due to events beyond its reasonable control, including but not limited to natural disasters, fire, flood, severe weather, epidemic, pandemic, public health emergency, labour disputes, power outages, internet or telecommunications failures, government orders, civil unrest, war, or acts of God.

In such circumstances, we may, at our discretion and where reasonably possible, provide alternative arrangements such as remote instruction, rescheduling, credits, or other reasonable measures.

10. Changes to Terms

Maple Ridge Learning Academy may update or modify these Terms from time to time to reflect changes in our services, business practices, or legal requirements.

When changes are made, we will post the updated Terms or otherwise provide notice as required by law. Your continued use of our services after the effective date of the updated Terms constitutes acceptance of the revised Terms.

If you do not agree to the updated Terms, you must discontinue use of the services and, where applicable, notify us of your intent to withdraw from the program.

11. Applicable Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Subject to any mandatory consumer protection or other applicable legal rights, the parties agree that the courts located in the judicial district of Montréal, Quebec shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the services provided by Maple Ridge Learning Academy.

13. Severability Clause

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

Any invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, while preserving the original intent as closely as possible.

By enrolling in, accessing, or using the services of Maple Ridge Learning Academy, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
